The European Court of Justice dismissed a nullity claim filed by Kyrgyz carrier Global 8 Airlines, ruling the claim inadmissible because the EU flight ban decision was not subject to a nullity claim.

Global 8 Airlines had purchased two aircraft from a Russian company and later discovered the aircraft were covered by an EU ban that prohibits their takeoff, landing, and overflight within the EU; the Court noted that the preliminary court had not conducted an analysis before upholding the ban and that the EU Commission played a prominent role in adding the aircraft to the ban list.
